1 The plaintiff in error, William Randall Steiner, hereinafter referred to as defendant, was charged by information in the district court of Tulsa County with the crime of grand larceny; was tried before a jury, convicted and the jury being unable to agree upon the penalty to be assessed left that to the court, who assessed punishment at confinement in the State Penitentiary for a period of three years. Appeal has been duly perfected.
